Terms of Sale

These Terms of Sale apply to consumer purchases made directly through nitho.com. They do not govern purchases from an independent retailer, distributor or marketplace, whose own sales terms apply.

Seller and contract

The seller is MTM Technology Limited, Business Registration No. 37056955, 820 Ocean Centre, 5 Canton Road, Kowloon, Hong Kong. References to NiTHO, we, us or our mean MTM Technology Limited in its capacity as seller. NiTHO is a trademark owned by MTM Group Limited.

By placing an order, you offer to purchase the products in your cart under these Terms of Sale. An automated order acknowledgement confirms receipt but does not necessarily constitute acceptance. The contract is formed when we confirm acceptance or dispatch the product, whichever occurs first. We may reject or cancel an order before acceptance, including for unavailability, payment failure, suspected fraud, delivery restrictions or a material pricing error. If payment has already been collected for a cancelled order, it will be returned using the original payment method.

Eligibility and account information

You must have legal capacity to enter into the purchase and must provide accurate billing, delivery and contact information. You are responsible for safeguarding your account credentials and for promptly correcting information that may affect fulfilment.

Products and availability

Product descriptions, compatibility information, images and specifications are provided to help you make an informed choice. Minor colour differences may result from displays or production variations. Availability is not guaranteed until the order is accepted. A product shown with a zero price, unavailable status or retailer-only instruction is not offered for direct purchase unless checkout clearly permits a valid paid order.

Prices, taxes and duties

The price, currency, applicable taxes collected by us, delivery charges and order total are displayed before you place the order. Where customs duties, import taxes or carrier fees are not collected at checkout, they may be charged by the destination authority or carrier. We will not add optional charges without your express agreement.

Payment

Payments are processed through the methods shown at checkout. Payment information is handled by Shopify and the applicable payment provider. We do not receive or store the complete payment card number. We may use payment and order information to prevent fraud and verify the transaction.

Delivery

Available destinations and the estimated dispatch or delivery period for an order are shown at checkout or in the order confirmation. Delivery dates are estimates unless expressly stated as guaranteed. Please review the Shipping and Delivery Policy for address changes, tracking, delays, damage and import charges.

Cancellations, returns and refunds

To request cancellation before dispatch, contact us promptly at info@nitho.com. We cannot guarantee cancellation after fulfilment has started. Returns, withdrawals, exchanges and refunds are governed by the Returns, Refunds and Cancellations Policy. Products must not be sent back until an RMA and receiving address have been issued by a customer service operator.

Warranty and statutory rights

The Warranty and Repairs Policy explains the NiTHO commercial warranty and claim procedure. These terms do not exclude or reduce rights that cannot lawfully be limited, including rights relating to faulty, unsafe, misdescribed or non-conforming goods.

Liability

Nothing in these Terms excludes liability that cannot legally be excluded. To the maximum extent permitted by applicable law, we are not responsible for indirect or unforeseeable loss, loss caused by misuse, unauthorised modification, failure to follow product instructions, or incompatibility not stated in the product information available at purchase. This limitation does not affect remedies for defective or non-conforming goods.

Governing law and disputes

These Terms are governed by the laws of Hong Kong. This choice does not deprive a consumer of mandatory protections available under the law of the country where the consumer habitually resides when those protections apply. Please contact info@nitho.com first so that we can try to resolve a complaint directly. A consumer may also use any court, regulator or dispute-resolution route available under applicable mandatory law.

Changes

The version presented before an order is placed applies to that order. We may update these Terms for future orders by publishing a revised version and date.
